Nigerian Wants Google To Pay N500m For Libelious Publication
Justice Adedayo Oyebanji of Lagos High
Court in Igbosere Monday fixed June 18 for a preliminary objection
hearing filed by google internet service provider, in a N500 million
libel suit filed by one Mr Nicholas Okoye.
Okoye, Chairman of Anabel Group of companies, is accussing Google incorporation for improper editorial censorship over a libelious publication.
Other defendants in the suit are: Mrs Ladun Liadi, a blog operator and Google Nigeria as first and third defendants.
However, Google, through its counsel, E.A Bahabo had filed a motion, challenging the jurisdiction of the court jurisdiction to hear the suit.
Counsel to the claimant, Mr Emeka Okwosa had filed an application for interlocutory injunction to prevent the defendants from further publication of the libelious documents till judgement is passed on the case.
Mr A.I Enaefo, counsel to the first defendant, said that his clients had complied and there is no evidence that the libelious publication had been downloaded.
Enaefo said: "My clients have complied to that and up to this moment, there is still nothing to show that the libelious publication had been downloaded."
In his response, Mr E.K Bahabo, counsel to the second and third defendants then told the court that two applications have been filed on motion challenging the court jurisdiction to hear the matter and that the name of the third defendant which is Google Nig. be struck out.
"We have filed two applications challenging the court jurisdiction to hear the matter and that the name of the third defendant which is Google Nig. be struck out," he said.
After listening to both parties, the judge then adjourned the case to June 18 for hearing of motion challenging the court’s jurisdiction to hear the matter.
